What is Altruistic Surrogacy?

Altruistic surrogacy means a woman carries a baby for another couple without taking money for it. She does this only to help them, not for profit. The couple only covers her medical expenses, food, and basic care.

In India, commercial surrogacy (where a surrogate is paid) is banned. Only altruistic surrogacy is allowed under the law passed in 2021.

Rules & Definitions of Altruistic Surrogacy (2021 Act)

Rule 1

“Altruistic surrogacy” means surrogacy in which the surrogate mother (or her dependents/representative) is not given any charges, fees, remuneration, reward, or monetary incentive of any kind, except reimbursement of medical expenses, other prescribed expenses, and insurance coverage for the surrogate mother.

Rule 2

“Commercial altruistic surrogacy” means commercialization of altruistic surrogacy services or procedures or any of their components, including selling or buying human embryos or gametes, or trading/selling/buying surrogate motherhood services by paying any money, reward, benefit, fees, or remuneration in cash or kind to the surrogate (or her dependents/representative), except reimbursement of medical expenses, other prescribed expenses, and insurance coverage for the surrogate mother.

Rule 3

“Couple” means a legally married Indian man and woman above the ages of 21 years and 18 years, respectively.

Rule 4

“Insurance” means an arrangement by which a company, individual, or intending couple guarantees compensation for medical expenses, health issues, specified loss, damage, illness, or death of the surrogate mother, and other prescribed expenses incurred on her during the altruistic surrogacy process.

Rule 5

“Intending couple” means a couple with a medical indication requiring gestational altruistic surrogacy and who intend to become parents through altruistic surrogacy.

Rule 6

“Intending woman” means an Indian woman who is a widow or divorcee between 35 and 45 years of age and who intends to avail altruistic surrogacy.

Rule 7

“Altruistic surrogacy” (as a practice) means a practice in which one woman carries and gives birth to a child for an intending couple, with the intention of handing over the child to the intending couple after birth.

Rule 8

“Surrogacy clinic” means any clinic, Center, laboratory, ART bank, genetic counselling Center, genetic laboratory, IVF Center, or any clinical establishment, by whatever name called, that conducts ART/IVF services and carries out altruistic surrogacy procedures in any form.
